Mediation

Mediation is the use of a neutral expert in conflict resolution to ensure everyone in a dispute can be heard and understood while looking for mutually acceptable ways to move forward. A mediator assists parties in exploring creative solutions that fit their individual needs. Mediation is a confidential process and provides the opportunity to explore many possible ideas without fear of being locked in or having something used against you in court.  Between 75 – 85% of cases are resolved in mediation; if that is the case for you, documents are prepared that you can have reviewed by your attorney, or we can help you submit those to the Court. Even if you do not get your case resolved, the process helps participants have a clearer understanding of their own goals and of the other party’s goals as well.

Preparation for Mediation

At Dispute Resolution Center, we begin by having participants complete intake forms, which are reviewed prior to meeting. This can assist you in narrowing down what is most important to you. The process of filling out these forms often helps give clarity on your case. This intake form gives us the information we need to design a process that fits your unique situation. One of the great things about meditation is it is flexible and is designed to meet the needs of the participants. Depending on the type of case, there may be reason to schedule individual meetings with each party prior to meeting together. In some cases, it makes sense to begin with joint appointments.

What happens in Joint Appointments?

In joint appointments the goal is to gain a greater understanding of the various perspectives on the situation and look for mutually acceptable solutions to any and all of the issues brought to the table. Mediation is founded on the principal of self-determination; you will never be forced to agree to anything.

Rarely can a client not get ahold of a mediator in our office if they need one. If your mediator is not available, our staff or another mediator can almost always get you an answer if you have a question.
